Statement of Economic Interests - Form 700

Why File Form 700? The California Political Reform Act requires certain state and local government officials, employees and consultants to publicly disclose their private economic interests on the Form 700, Statement of Economic Interests. They must also disqualify themselves from participating in decisions that may affect their personal financial interests. The Fair Political Practices Commission (FPPC) is the State agency responsible for issuing the Statement of Economic Interests (Form 700), and for interpreting the law’s provisions.

Who Files? This is determined by State law (Government Code section 87200) and an agency’s Conflict of Interest Code.

Elected and appointed officials and candidates that must file are listed in Government Code Section 87200 and include but are not limited to: members of the Board of Supervisors, District Attorneys, County Counsels, County Treasurers, Chief Administrative Officers of Counties, specified Boards and Commissions, and other public officials who manage public investments, and candidates for any of these offices at any election.

Additionally, employees and consultants who hold a position designated in their agency’s Conflict of Interest Code are required to file a Statement of Economic Interest to disclose information as required by the disclosure category. Disclosure categories set out the type of financial interests that must be reported by each official. The code lists each position within the agency filled by individuals who make or participate in making governmental decisions that could affect their personal economic interests.

When Must Form 700 Be Filed? There are three types of Form 700 Filings (Assuming Office, Leaving Office and Annual Statement). The deadlines for submitting these types of Statements of Economic Interests Form 700 are as follows:

  • Assuming Office: within 30 days of the assumed office date
  • Annual: Due by April 1 each year (this covers the period of January 1 through December 31 of the previous calendar year unless otherwise noted)
  • Leaving Office: within 30 days of the leaving office date

If you assumed office between October 1 and December 31, Assuming Office Form 700 will act as both assuming office and annual combined.

If you discover errors or omissions on any statement, file an amendment as soon as possible. You are only required to amend the schedule that needs to be revised (it is not necessary to refile the entire form). Amendment schedules can be obtained from the Fair Political Practices Commission website.

It’s important to file on time. If a Code Filer fails to timely file his or her Form 700 and that failure is referred to the FPPC’s Enforcement Division, a penalty may be imposed.

Where Must Form 700 Be Filed? Persons holding the office of and candidates for the office of Chief Administrative Officer, District Attorney, County Counsel, Auditor-Controller/Treasurer-Tax Collector and members of the Board of Supervisors file with the County Clerk/Registrar of Voters. Those filing pursuant to a Conflict of Interest Code file their original Form 700 as stated in the Conflict of Interest Code.   

Filers who are required to file their original Form 700 with the Clerk of the Board of Supervisors should complete their Form 700 online. The County of Fresno uses eDisclosure which assists filers in filling out their form accurately and completely. How do I obtain copies of Form 700s? The following officials, identified in California Government Code Section 87200, file Statements of Economic Interests (Form 700) with the office of the County Clerk/Registrar of Voters:

  • Board of Supervisors
  • County Administrative Officer
  • County Counsel
  • District Attorney
  • Auditor-Controller/Treasurer-Tax Collector

Copies of their Statements of Economic Interests can be obtained by visiting the office of the Fair Political Practices Commission or the County Clerk/Registrar of Voters office.

Statements of Economic Interests for some state and local government agency elected officers may be available in an electronic format on the Fair Political Practices Commission website. 

Some elected county officials other than those listed above, county department heads, and the top executive and board members of school and special districts and boards, commissions and committees designated in their agency’s Conflict of Interest Code are required to file their Statements of Economic Interests with the Clerk of the Board of Supervisors. Copies of their Statements of Economic Interests can be obtained by visiting the office of the Clerk of the Board of Supervisors.

Finally, for those employees, board, commission or committee members, or consultants designated in their agency’s Conflict of Interest Code to file their Form 700 with the filing officer in their County department, copies of their Statements of Economic Interests can be obtained from that County department filing officer.
